Terms of service

Effective 10 October 2026.

These terms are an agreement between you and Tatako, Inc., a Delaware corporation (“Tatako”, “we”, “us”). They cover the website tatako.com, the lessons at app.tatako.com and any Tatako app (together, “Tatako”). Our Privacy policy and Subscriptions and refunds are part of these terms. By creating an account or using Tatako, you agree to them. If you don’t agree, please don’t use Tatako.

Who can use Tatako

• Tatako is made for young children who learn English together with a parent or another grown-up who looks after them.
• Only an adult (18 or older, or the age of majority where you live) can create an account, pay or change settings. You are responsible for how children use Tatako on your account.
• Children use Tatako with a grown-up nearby. Children don’t create accounts and don’t buy anything.

Your account

• You sign in with Google or another sign-in method we offer. Keep access to it safe, and write to us through our contact form if you think someone else has used your account.
• An account is for your own family. Don’t share, sell or rent it.
• You can stop using Tatako at any time, erase your progress on the grown-ups screen or ask us to delete your account.

Free lessons and paid plans

Some lessons are free. Full access may require a paid plan. Before you pay, we show the price, how often you’ll be charged and what’s included. Billing, renewal, cancellation and refunds are described in Subscriptions and refunds.

Family photos

You can add photos so the drawings in the lessons wear your family’s faces. The photos stay on your device and are never sent to us. Add only photos you have the right to use.

What you may and may not do

Use Tatako for your family’s personal, non-commercial learning. Please don’t:

• copy, sell, rent or share lessons, pictures, sounds or other content outside your family;
• get around payments, free-lesson limits or device limits;
• copy, scrape, decompile or reverse engineer Tatako, except where the law allows it;
• interfere with or overload our systems, or open accounts that aren’t yours;
• use Tatako to break the law or to harm anyone.

Our content

The lessons, words, pictures, sounds, voices, the octopus Tatako, the Tatako name and logo, and the software belong to Tatako, Inc. or its licensors and are protected by law. While you follow these terms, we give you a personal, limited, non-exclusive, non-transferable license to use Tatako for your family. We may end this license if you break these terms.

If you send us ideas or suggestions, we may use them freely and without payment.

Learning results

Tatako helps children practice English through play. Every child learns at their own pace, so we can’t promise specific results. Tatako is not a medical, speech therapy or professional education service. If you’re worried about your child’s speech or development, talk to a doctor or a speech therapist.

Changes to Tatako and to these terms

• We keep improving Tatako and may add, change or remove lessons and features. We work to keep Tatako available, but we can’t promise it will always be uninterrupted or free of errors.
• If we change these terms in a way that matters, we’ll tell you in advance by email or in the lessons. Changes to a paid plan apply from your next renewal. If you keep using Tatako after a change takes effect, you accept it. If you don’t agree, cancel your plan and stop using Tatako.

Ending use

You can stop using Tatako at any time. We may suspend or close an account that breaks these terms or the law, or puts children or others at risk. If we close a paid account through no fault of yours, we’ll refund the unused part of the current period.

Disclaimers

Tatako is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some places don’t allow these exclusions, so some of them may not apply to you.

Limitation of liability

To the extent the law allows, Tatako, Inc. and its directors, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim related to Tatako is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Nothing in these terms limits liability that can’t be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

Disputes

• Let’s talk first. Write to us through our contact form and describe the problem. We’ll try to solve it within 60 days.
• These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Claims go to the state or federal courts located in Delaware, but either of us may bring a claim in a small claims court where you live.
• If you live outside the United States, you keep the protection of the mandatory laws of your country and may bring a claim in your local courts where those laws give you that right.
• To the extent the law allows, claims are brought individually and not as part of a class or representative action.

App stores

If you get Tatako from the App Store or Google Play, that store’s terms also apply to your download and purchases. Apple and Google are not responsible for Tatako or its support. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.

Legal notices

Send notices to Tatako, Inc. through our contact form and by mail to 131 Continental Dr, Suite 305, Newark, DE 19713, USA. Legal process may be served on our registered agent in Delaware, Legalinc Corporate Services Inc., at the same address. We send notices to the email address on your account.

Other terms

These terms, the Privacy policy and Subscriptions and refunds are the whole agreement between you and us about Tatako. If a part of them can’t be enforced, the rest still applies. If we don’t enforce a term right away, we haven’t given up the right to enforce it later. You may not transfer these terms to anyone else. We may transfer them as part of a merger, acquisition or sale of our business.
